I was with my new Buyer the other day touring some homes he had wanted to see. This Buyer likes to work on his cars and wants to make sure he is in a neighborhood that won’t have an issue with this.
One of the homes we saw was in an HOA.
Yeah, I feel the same way about HOA’s, but the monthly fee was $45 and the house was one of the nicer homes we saw that day.
I told my Buyer that I can get ahold of the HOA documents prior to him submitting an offer so we can double check that he won’t have any issue working on his cars at this property if he chooses to submit an offer.
Or so I thought 💭
I reached out to the Listing Agent who sent me the HOA CC&R’s (covenants, conditions, and restrictions). Ok, cool. Thanks, but that was not the document that we needed from the Seller regarding the HOA.
We were looking for the Rules & Regulations document only to be told that the CC&R’s was the only document the Listing side had from the HOA.
🛑 STOP
In Utah, section 7.1 of the Real Estate Purchase Contract clearly lays out the documents a Seller needs to provide a Buyer when they go under contract. There is a deadline for these documents, and it is the very first deadline (outside of acceptance/counter/rejection) of the agreement.
Not only was I told that the Listing Agent didn’t have all of the required documents yet, but I was also told I could email the HOA management company to ask for copies.
This is not the job of the Buyer’s Realtor!!! 😡
At this point, there are too many red flags being thrown out that I tell the Buyer my advice is to keep looking at properties unless he really wants to move forward with this house he saw. 🚩
It get’s better though.
The Listing Agent texts me to say they received an offer. Clearly she is trying to get competing offers to push the purchase price as high as possible. I told her the Buyer is no longer interested and that I hope she can obtain all of the documents needed to the Buyer by their deadline. If the Listing Agent doesn’t then the Seller side is already in default of the contract and that is not a good place to be at.
Why do Realtors suck?
Lack of competence.
The Listing Agent should have had all of the required documents prior to listing the property. Have everything ready to go that is required, by law, to be delivered to the Buyer before listing the property.
It’s not that difficult to have all of your dicks in a row. 🦆
